
Terms of Service Agreement
Effective Date: 9/25/2023
This Short-Term Rental Terms of Service Agreement ("Agreement") is entered into between the Property Owner (hereinafter referred to as the "Owner") and the Guest (hereinafter referred to as the "Guest") for the rental of the property located at [Property Address] (hereinafter referred to as the "Property").
1. Rental Period:
The rental period begins on Start Date at Check-In Time and ends on End Date at Check-Out Time specified in the confirmation provided. Any extension of the rental period must be agreed upon in writing and may be subject to additional fees.
2. Rental Payment:
The Guest agrees to pay the total rental fee specified in the confirmation. Rental fee is fully refundable until 14 days before Start Date. Cancellation or alteration made within 14 days before Start Date are subject to Owner’s discretion, and rental fee will not be refunded within 14 days before Start Date.
3. Security Deposit:
A security deposit of 100% of the rental cost is required upon booking.
The security deposit will be refunded within [Number of Days] days after check-out, subject to inspection for damages or violations of this Agreement.
4. Property Use:
The Property is to be used for short-term residential purposes only.
The Guest agrees not to engage in any illegal activities on the Property.
Parties, gatherings, or events are not permitted without prior written consent from the Owner.
5. Check-In and Check-Out:
Check-in time is after 2 PM, and check-out time is by 12 PM.
Late check-out without prior approval may result in additional charges.
6. House Rules:
The Guest agrees to abide by any house rules provided by the Owner.
Smoking is not allowed inside the Property.
Pets are not allowed unless specifically agreed upon in writing.
Common areas are provided for everyone’s convenience, and guests should clean common areas after their use. Any unclean common areas may result in additional charges equal to the cost of cleaning.
Quiet time is between 10 PM and 8 AM. Any excessive noise during the period will result in immediate warning, and are subject to additional penalties if warning does not stop the noise.
Guests will receive the keys to enter and exit the property and shall return the keys by putting them on the desk inside their room after notifying Owner. Unless otherwise agreed in writing, failure to return the keys as instructed will result in additional charges equal to the cost of replacing keys.
7. Maintenance and Care:
The Guest is responsible for maintaining the Property in good condition during the rental period.
Any damages or issues must be reported to the Owner immediately.
8. Liability:
The Owner shall not be liable for any accidents, injuries, or losses that occur on the Property during the rental period.
The Guest is encouraged to obtain travel insurance for personal belongings and potential trip interruptions.
9. Termination:
The Owner reserves the right to terminate this Agreement and evict the Guest in the event of violation of these terms or disruptive behavior.
10. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of New York.
11. Entire Agreement:
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings.
By booking the Property, the Guest acknowledges and agrees to abide by the terms and conditions of this Agreement.
